ZapTunes.com is a gigantic scam. They used to trick people into believing they could sign up for the service – handing over their credit card details in the process – and instantly gain access to an online music catalog of more than 8 million DRM-free songs they could legally download. For $25 a month.
Of course, the ‘startup’ was quickly and diligently called out for being a devious fraud, by TorrentFreak for one. Of course, it wasn’t so hard to identify ZapTunes as a huge scam – they were stupid enough to claim they’d signed a licensing deal that enabled it to offer music from The Beatles (this was way before Apple got to that point).
Anyway, they announced their shutdown just months after launching, to no one’s surprise but undoubtedly not after taking some gullible people’s money.
In their own press release, they stated that “from the very first day of its launch, ZapTunes had been struggling against numerous DMCA complaints and lawsuits that were brought against it by a handful of label companies”.
This morning, however, the fraudulent company announced its return, this time billing itself as a social music discovery network. They will stop offering free music downloads, and all existing subscriptions are to be canceled as soon as the new website is launched.
Although ZapTunes mentions how it has struggled to “get to a point of profit” to date, the company says it has attracted 25,000 subscribers to its free music download service, which, again, sets those users back $25 per month.
I sincerely hope that, too, is a lie, and far fewer people got tricked by these fraudsters.
The reason for this post is simple: I want as many people as possible to land on this blog post or the ones I linked to above when doing a search for ZapTunes, in the hopes of making them realize they should stay far, far away from it.

promises to be a high-profile chairmanship of the top oversight
committee in Congress.
According to an outline of hearing topics obtained by POLITICO, the
House Oversight and Government Reform Committee is also planning to
investigate how regulation affects job creation, the roles of Fannie Mae
and Freddie Mac in the foreclosure crisis, recalls at the Food and Drug
Administration and the failure of the Financial Crisis Inquiry
Commission to agree on the causes of the market meltdown.
But apparently somebody forgot to tell the Wall Street Journal about Darrell Issa, because last October, on the eve of the midterm elections when Republicans were trying to push the image of responsible legislators, the Journal published a profile of Issa in which he stressed his interest in working with the White House and downplayed any investigations he might launch.

“A band of Senate Democrats signaled on Monday that it would press forward when Congress convenes this week with a proposal to curtail filibusters and other methods of slowing the chamber’s work.” Democrats will likely use some “procedural sleight-of-hand” to buy time for negotiations with Republicans over rule changes, delaying implementation for a few weeks.
Sen. Robert Menendez (D-NJ) plans to reach out to Sen. Lindsey Graham (R-SC) to craft a bipartisan immigration reform bill in the new Congress, but it is unclear if Graham will respond favorably to Menendez’s outreach. Otherwise, Menendez said he will introduce his own bill. “If there’s nothing to have hearings about, nothing to debate over, you will never move forward,” he said last month.
And finally: While debating the authenticity of Sen. Lindsey Graham’s (R-SC) new tan, MSNBC host Joe Scarborough wondered if the senator was attempting to mimic pop star David Bowie’s space-traveling alter ego. “Did you follow David Bowie through the Ziggy Stardust years? He had more makeup than Bowie did,” Scarborough said of Graham. “I think the senator was just out in the sun over the holidays,” replied co-host Willie Geist.

Paypal is the top dog when it comes to online payment services. It is generally easy to use and a relatively secure way to send money while buying products & services online (whether eBay or other online merchants), but it does have its downsides. The web is filled with folks who have had their Paypal account frozen with no explanation and it can severely impact a business (or person) if it affects you for a length of time.
Addressing the some of the downsides of Paypal, other businesses have ‘stepped up’ to provide their own payment services. They range from smaller startups to well established players throwing their hat in the online payment arena. Mostly the service that would work best for you depends most upon what you actually use online money transfers for. With Paypal, many people only use a certain aspect of it while never touching others. Let’s go over a few of these online payment services and check out the differences and why you might use one over another.
1. Venmo
Venmo is a Philadelphia-based startup in the mobile payment arena. Starting as a cell-phone based payment system, you can also send payment or a bill to a friend whom you have already connected with or to any cell phone, email address or twitter handle.
Much like Paypal, you carry a balance and your payments or charges credit and debit that balance. You add more funds by linking a credit card or bank account and Venmo uses bank-grade security throughout the transaction process.
Venmo started as a “Friend” payment service but you can also sign up as a business as long as you have a cell phone to coordinate payments. For Friend-to-Friend transfers there is no fee. Staff writer Steve is already a great fan of Venmo and I have seen its use expanding to more and more people.
Venmo is still invite-only but they were kind enough to set up a special invite code for MakeUseOf readers. Use ‘makeuseof‘ while signing up to gain access instantly.
2. Amazon WebPay
Amazon released their payments service back in 2008. Originally meant for merchants, they have also added a “personal” aspect to it named WebPay where you can send or receive money online or via cell phone. The Amazon Payments/Personal website has more details on the requirements for signing up.
3. Google Checkout
Google Checkout is definitely aimed at merchants more than anyone else. It takes the payment portion out of the transaction so that you simply send a buyer of your products to a checkout page which is powered by Google Checkout. When on that page, a buyer will enter their payment information – and then be sent back to your site with a confirmation of purchase.
4. Skrill / Moneybookers
Moneybookers is widely known as a replacement to PayPal which is also more international-friendly than some of the other providers. Moneybooks is beginning a transformation to Skrill – a rebranding and refocusing of their payment platforms. Their rates are usually cheaper than PayPal, but then again less people use it so that is the tradeoff you have. I’ve heard of a lot of folks turning to Moneybookers when PayPal has crossed them and they are mostly happy with their move.
5. 2Checkout
2Checkout is a payment processor which acts as a “middleman” between you (as a seller of items or services) and the payer. 2Checkout can accept credit cards, checks, and even PayPal itself as a form of payment but ads a management layer as well handling the whole checkout process. I’ve seen many merchants using 2Checkout as a payment provider on eBay stores as an alternative to PayPal. There is a $49 signup fee; so this is mainly meant for those with some higher volume sales and not casual transactions.
6. Traditional Merchant Accounts
Finally on the ‘merchant’ end again, you can do what other businesses have been doing for decades and apply for a real merchant account. Having a merchant account gives you, with the use of a payment processor such as Authorize.Net, the ability to accept credit cards directly. There are some downsides to this. There is often a monthly fee that the other providers above to not charge, and you must be PCI compliant which is a whole other issue. However if you perform a lot of transactions and need to integrate a payment solution into your own shopping cart or system, then this is the only way to go.
Ask your local bank about merchant accounts, alternatively there are a ton of options available online (check Google) but frankly there are so many options it is hard to tell from the web which will work for you. Ask your friends for recommendations and do your homework to make sure you are going with a reputably provider (I’ve used BluePay, and they have been good but fee-expensive).
Which One Is For Me?
The answer to this question depends a lot on how you use the online payment service. If you simply transfer money between friends – as a sort of IOU – then Venmo would definitely be my recommendation. If you are selling items to ‘strangers’ they might be put-off by Venmo simply because they are not well known, and in this case going with a bigger name such as Google or Amazon may work best. Finally if you are a high volume merchant or just do a lot of business, it would be wise to evaluate the other options to see what works best with you.

Making Free Money Online
I’ve often wondered if the early Web pioneers had it all to do over again if Web companies would have put less of an emphasis on free.
People have been conditioned against paying for services or content on the Web, and the Web elite only have each other to blame. For all the talk of Web companies getting users first and “figuring out” how to make money later, the only two jaw-droppingly, multi-billion-dollar, innovative new ways to advertise online have been Google’s paid search ads and Groupon’s solution to unlocking local ad dollars on a mass scale. Those who win big–like Google– just perpetuate the cult of free content and services as a way of spoiling would be competitors. Witness a big disconnect between popularity and money. Exhibit A: Yahoo.
As a result, Netflix and Match.com are two of the only companies to have figured out ways to build large, lucrative subscription businesses online. Meanwhile, LinkedIn is one of the only Web 2.0 companies that has created a huge business with a freemium business model.
But on the mobile Web it’s a do-over, and it’s a totally different playbook from FREE! People are conditioned to pay for stuff over phones in a way they aren’t online, and they’re not flinching. According to Citibank’s US Internet Stock 2011 Playbook released today, Apple will generated as much as $2 billion in gross app revenue in 2011. For perspective, that’s about the same size as Citibank’s estimate for the entire online video advertising market next year, nevermind way more people watch YouTube than have an iPhone and it’s been in the cultural zeitgeist longer.
The report also cites Gartner’s estimates that the total app market was around $4 billion in 2010 and should grow to a whopping $27 billion by 2013. The biggest driver is smart phone penetration, the impact of which Citibank compares to the spread of broadband on the computer-based Internet in the early 2000s. Globally, smart phone unit sales grew 53% in 2010, and Citibank expects it to grow 29% in 2011 and stay in the mid-20% growth range through 2013.
Several years ago, it was controversial to say that a fledgling product called Android — not the hyped up purchase of YouTube– would be Google’s best bet at another hit on the scale of paid search. Android is already making $1 billion in revenues with an indirect monetization strategy, and Citibank expects that could double next year– not only eclipsing YouTube but the entire online video category. Now calling Android Google’s future is almost a cliche. Good thing Google hedged its bets.
My guest on Hedge Fund Radio this week is penny stock trader and Internet entrepreneur, Tim Sykes. Every once in a while I run into a natural born trader, someone who crawls out of the crib quoting options spreads, price earnings multiples, and book values. His first spoken word was “Sell!” While other kids were practicing their ABC’s, Tim was pouring through prospectii.
During his college years, Tim skipped classes and turned a $12,415 Bar Mitzvah gift into $1.65 million by trading the market from his dorm room. By the time he graduated from Tulane in 2003, he was already running his own hedge fund. Barclays Bank rated it the number one short bias fund during 2003-2006.
Tim argues that if you cut through all the hype and manipulation in the penny stock market, it is clear that there are huge opportunities on the short side. Most of the companies trading there are frauds, and most will fail. Mini Enron’s and mini Madoff’s abound.
Defined as trading under $5 a share, these stocks are purchased mostly by individuals desperate for “get rich quick” success. Promoters buy lists of email addresses from major online publishers, sometimes paying millions of dollars, to launch a never ending onslaught of “pump and dump” schemes. Email barrages and Twitter spam have replaced the dinnertime telemarketing calls and junk mail of yore.
The SEC is so inundated with tips on Madoff copycats and competitors ratting out each other, they don’t have time to pursue gripes about $1,000 losses emanating from penny stock scams. It’s like expecting the FBI to pursue shoplifters of 99 cent items from Seven Eleven stores.
Some of the claims made by these bogus IPO’s boggle the imagination. Tim’s favorite was one company’s efforts to promote vitamins infused with stem cells. Another offered a solar spray that turned you house into an energy source. Then there was the BP Gulf oil spill that threw up innumerable crude eating forms of algae. As for my own experience, I’ll never forget the aquaculture farm in the middle of the Saudi Arabian desert. To separate out the obvious rip offs from the legitimate companies, Tim spends hours a day gleaning through voluminous SEC filings, some of which are blatant cut and paste jobs from earlier failed floatations.
Even though most of these companies are fake, prices can run away to the upside, wiping out the early short sellers. So some risk control discipline is required. When a stock truly rockets, “buy-ins” of shorts can also be a problem. A few hundred penny stocks are launched each year, but only about five a month catch on fire. And remember, Apple (AAPL), and True Religion (TRLG) jeans were once penny stocks.
To avoid being taken to the cleaners by unscrupulous con men, Tim offers some very basic advice. If it is too good to be true, it generally is. It also helps to read the SEC filings, which can be obtained online for free.
Tim claims to have a success rate with his short strategy of 75%, which has delivered a 56% return in 2010, proving he still has the golden touch. His problem is that the strategy is not scalable, and can only be executed with a small amount of money. No mega hedge fund for him.

Who's Making Money
Fishing for compliments is something of a misdemeanor in most social circles — unless your circle is the Internet and you’re fishing with a shiny, new vanity app.
ThreeWords.me is making the rounds this week. It’s a simple app that lets you solicit three-word responses from your friends around the web. Each respondent simply goes to your unique ThreeWords.me URL and enters three words about you.
Your friends can also add comments along with their three words, and you can reply to any entries. In your dashboard, you can see which words people entered the most.
You might get a lot of complimentary words, but be warned, o ye of little self-confidence: The app allows for anonymous commenting, so steel yourself for trolls, profanity and put-downs. You can delete any of the entries at your discretion. You can also choose to make all your responses private.
The premise is ever so grade school, which adds to the app’s charm. While ThreeWords.me is without question a slightly narcissistic game aimed squarely at the perpetually insecure social media scene, it’s nevertheless cute and catching on like wildfire through
Its UI is simple, as well. You get to upload a background image and profile photo; other than that, the pages are decidedly bare-bones and lacking in the design department. Then again, the design isn’t what matters about this app; getting people to talk about — and hopefully compliment — you is what drives traffic to the pages in this case.

You can connect the app to Facebook, but sadly, you can’t use Facebook or Twitter to find your friends who are also using the app. You’ll have to do that part manually, a major shortcoming that’s likely holding the app back quite a bit in terms of adoption and growth.

The app was created by college freshman Mark Bao, a teenager who’s been trying his hand at web-based entrepreneurialism for quite some time already. While we don’t see ThreeWords.me as a money-making endeavor right now, we’re sure the exposure can’t hurt.

Wednesday Worries – Ireland “Fixed” – Who’s Next?

So many things are pissing me off today.
I got my political outrage out of the way in my earlier post: "Thanks for the Gas Money, Mr. President," so we don't need to talk about that again. Ireland, as of 7:45, has not actually voted to accept the EU's deal, which will pull $20,000 per Irish family directly from national pension funds to pay for the speculative mistakes of Irish Banks. Additionally, the Irish people are being asked to borrow another $75,000 per family from the EU at about 6% interest, also to pay for the speculative mistakes made by the Irish Banks. While this may seem insane - it's only a drop in the bucket compared to what Americans are spending to bail out our own speculators so why shouldn't they join the club?
At least Ireland gets to vote for their obligations, we have a Federal Reserve System where a single man, known as "The Bernank" is able to spend what is now heading towards $3.5Tn of OUR MONEY to bail out his banking buddies. That's $31,818 per American family spent over two years IN ADDITION to the stuff I complained about Obama and our spineless Government spending in the last post. As I said, things are pissing me off today! I should be in a better mood - we had a fabulous day trading in Member Chat yesterday. In yesterday's post, I closed with "One last stab at making some bearish profits for us (see Morning Alert)" and you can click on that Alert, which was posted on Seeking Alpha and check out our trade ideas for the $10,000 to $50,000 Portfolio which included (at 7:22 am yesterday) QID Jan $10 calls, which opened at $1.80 and finished at $2 (up 11%), DIA Dec $114 puts, which opened at .80 and finished at $1.33 (up 66%), XRT Jan $44 puts, which opened at .35 and finished at .55 (up 57%), USO Jan $36 puts, which opened at .66 and finished at .90 (up 36%), PCLN weekly $400 puts, which opened at $.50 and finished at $1.40 (up 180%) and NFLX Jan $155 puts, which opened at $1.70 and finished at $2.30 (up 35%) but should look much better this morning, where we will exit. Of course I featured the idea to short NFLX last Thursday in the Morning Post (which you would get at 8:30 every morning in progress if you subscribed!) and we talked about shorting oil in the Weekend Post and I mentioned XRT last week as well so it's not like these are even our "super-secret" trade ideas - this is just the stuff that looked obvious enough to risk our small portfolio plays on (as you don't want to take too much risk in a small portfolio, even when it is aggressive like our virtual $10,000 Portfolio). Once we got into Member Chat for the morning we went with more aggressive trade ideas like PCLN weekly $410 puts at $1.60, which finished the day at $4.20 (up 162%) and 6 other plays that we're not done with yet plus shorts on the oil futures at $90 that worked out very well. So why am I angry? You can't really have a better day than we had yesterday. Yesterday is the reason we have sat patiently (well kind of patiently) in cash for a month as we finally got an opportunity to commit to a whole bunch of very obvious trades, the most trade ideas I've had in a single day since early September, when we jumped on Uncle Ben's bullish bandwagon. Sure we find things to trade every day but these are the opportunities we wait for. I guess I'm pissed because we had to pull our December short plays off the table because the cartoon bears have warned us that they will be "Buying the F'ing Dips" and we know better than to argue with cartoon bears because it's simplistic little BS premises like that that rule this market. Ah, that's why I'm angry! As I keep saying, I don't enjoy day trading - it's not satisfying but it's what we do while we wait for real investment opportunities to come along. While it may be exciting to make 100% on a trade in a single day - it's small money and a tedious (and stressful) way to build up a portfolio. I suppose at heart, I'm a long-term investing coupon-clipper but those kind of investors are being chewed up and spit out in this market and, while we found many, many things to buy earlier in the year, now we're down to one or two long-term opportunities a day while most of the rest of the market looks better as a short. But you can't even stay short past the closing bell. Even as I write this post our paranoia in taking the money and running (our usual strategy) on our quick gains is looking justified as the dollar is, as usual, being shoved off it's overnight highs (used to prop up the Nikkei in our famous "3am Trade") during the slower EU lunch break in order to now goose the US futures to give US markets the best possible open on the least possible amount of volume (ergo cost to the Gang of 12). Despite debasement efforts by Obama and The Bernank yesterday, the dollar still rose back to 80.81 in overnight trading and that sent the Dow futures all the way down to 11,285 but don't despair - they've already been goosed back to 11,350 - just 5 points shy of yesterday's weak close. See, in a "normal" market we would have simply stayed short because clearly the momentum was down and the fundamentals indicate that all the efforts of Obama, The Bernank, the BOJ, the BOC, the ECB... are "too little, too late" to put the Humpty Dumpty global economy back together again. Some of the fundamentals we're watching: These are just TODAY'S headlines and they all add up to RISK. Lack of risk recognition by the markets was the primary reason I called for cash in early November. We are approaching 2008 pre-crash market highs with many stock trading higher than they were then on LESS revenues than they had at the time. Meanwhile, 10% of our population is unemployed, consumer credit is down by over $1,000,000,000 (15%), household wealth is down 20% and income is down while the CPI, even by BS Government measures, is up 5% since then, effectively giving those people who still have jobs 5% less to spend anyway. And when you consider that discretionary income is just 20% of income - if the 80% they HAVE to spend went up 5%, then that's 4% of discretionary income gone, which is 20% of discretionary income out the window - FOR THE PEOPLE WHO ARE STILL WORKING. The other 10% have ZERO to spend and that's not good either. All of this is being ignored as "investors" buy stocks on the hopes that they will expand sales internationally and keep cutting costs despite the same inflation the speculators are using to justify their very high valuations. We're effectively writing off the US economy and placing all of our bullish eggs in the global basket - even though they have 20% unemployment "over there." - that's kind of nuts, don't you think? I'm not even going to ask if the above chart (from Calculated Risk) disturbs you . Clearly, from the results of the last election, it does not. We are over 6M jobs away from recovery and we added less than 40,000 last month. At least in Ireland, their population is shrinking, with 65,500 people (1.5%) abandoning the sinking ship as of April of this year. That's less likely to happen in America as Mexico is not that attractive and Canada doesn't want us and most people can't afford to move anyway as they are upside down on their mortgages so we, as a people, sit and wait. We sit and wait for something good to happen. Any minute now... Something good is bound to happen... NOW! OK, maybe not now but really soon - something good has got to happen, right? That pretty much sums up our national policy - we don't actually do anything to create jobs but if we sprinkle enough magical fairy money on the rich, we're sure they'll start hiring people real soon! Maybe as soon as they are done merging and acquiring smaller companies with all that money where they then create efficiencies by laying off 50,000 people a month (Challenger Job Cut Report) while more and more jobs are outsourced every day ($6Tn worth of jobs are currently outsourced). And why not? There are huge tax advantages to outsourcing US jobs - tax advantages that our President is perpetuating as he bends over and accepts the massive Republican tax cuts for the wealthy on behalf of the American people. Did I mention I was pissed? Good, then moving along... So we kept our Jan shorts and didn't add any longs because we expect a bounce on the usual opening nonsense but I don't see enough dry powder left for the bulls to take us over that critical Dow 11,500 mark. Meanwhile, CAT is way too high and they are a Dow component, as are XOM, CVX, IBM and MCD - all stocks that are major components in the price-weighted Dow and are more likely to pull back than move higher. EU money printing will not inflate our stocks - it may even boost the Buck and that would be bad for commodities, who had a pretty rough day yesterday (and we shorted a few). I wish it were easier and I wish we could just say "CAT is overbought so we're going short" but the fundamentals of the stock are trumped by rumors of infinite Chinese demand and inflation expectations that somehow ignore the negative impact of rising steel prices and increasing borrowing costs on the company. Of course the weak-dollar expectations have everyone moving into stocks, which are just another form of commodity to trade and, even as I write this, the dollar is being jammed back below 80.50 to goose the US open. At least we know how this game is rigged and we can have lots of fun betting the suckers never do find that red queen but what a shame that this is what the global economy has been reduced to - a shell game - and it's an empty shell at that!
